Term and Termination You may terminate the above license at any time by returning or destroying all copies of GeneXproTools in your possession and notifying Gepsoft. The above license will terminate immediately if you infringe upon Gepsoft’s copyrights or breach this agreement. 5. No Liability for Consequential Damages Neither Gepsoft nor its suppliers shall be liable to you or any third party for any indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, business interruption or the like), arising out of the use or inability to use GeneXproTools based on any theory of liability including breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if Gepsoft or its representatives have been advised of the possibility of such damages. GeneXproTools is not fault tolerant and is not designed, manufactured, or intended for use or resale as online control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of GeneXproTools could lead directly to death, personal injury, or severe physical or environment damage. 6. Academic License The Academic License of GeneXproTools cannot be used for commercial purposes and can only be acquired by educational institutions or equivalent. You cannot install and use the application outside the institution or distribute applications outside of it without purchasing a Commercial License of GeneXproTools. The Academic license is sold in packages of three licenses (Academic Professional) or 30 Licenses (Academic Enterprise).
